A complaint shall be submitted in writing by the grievant, or the grievant’s designee, as soon as possible, but no later than sixty (60) calendar days after the alleged violation to the ADA Coordinator at ADACoordinator@schev.edu or via the SCHEV ADA Grievance Form . Once the grievance is submitted to the ADA Coordinator, additional claims may not be added to it. Alternative means of filing a complaint, such as personal interviews or a tape recording of the complaint, will be made available upon request for persons with disabilities requiring use of alternate means.
Within 15 business calendar days after receipt of the complaint, the ADA Coordinator or the ADA Coordinator’s designee may contact the grievant, if necessary, for any clarification or additional information related to the complaint. Within 15 business calendar days of receipt of all requested supplemental or clarifying information, the ADA Coordinator or designee will respond in writing, and, where appropriate, in a format accessible to the grievant , such as large print, Braille, or audio tape. The response will explain SCHEV’s position and offer options for substantive resolution on the complaint.
If the written response by the ADA Coordinator or designee does not resolve the issue to the satisfaction of the grievant, the grievant or his/her designee may appeal the decision, within 15 calendar days after receipt of the response to the of the date of the ADA coordinator or designee’s written response, appeal the decision to the Executive Director of SCHEV. Any appeal should be in writing. Alternative means of filing an appeal, such as personal interviews or a tape recording of the appeal, may be made available for persons with disabilities requiring use of such alternate means upon request.
Within 15 calendar days after receipt of the appeal, the Executive Director or his designee may meet with the grievant, either in person or by telephone, to discuss the complaint and possible resolutions, if the Executive Director or his designee determines such a meeting would be helpful to the determination. Within 15 calendar days after the meeting, or within 30 calendar days of receipt of the appeal if there is no meeting, the Executive Director or his designee will respond in writing, and, where appropriate, in a format accessible to the grievant, with a final resolution of the complaint.
Record Retention
All complaints, supplemental or clarifying information, other correspondence or records received, and final determinations will be retained by SCHEV for three years from the date of the final determination by the ADA Coordinator or the Executive Director if appealed.
