NOTICE UNDER THE AMERICANS WITH DISABILITIES ACT

In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990 (“ADA”), the State Council of Higher Education for Virginia (SCHEV) will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs or activities.

Employment: SCHEV does not discriminate on the basis of disability in its hiring or  employment practices and complies with all regulations promulgated by the U.S. Equal Opportunity Commission under Title I of the ADA.

Effective Communication: SCHEV will generally, upon request, provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in SCHEV’s programs, services and activities, including qualified sign language interpreters, documents in Braille and other ways of making information and communications accessible to people who have speech, hearing or vision impairments.

We welcome individuals with disabilities who require the assistance of service animals or emotional support animals. In accordance with applicable federal, state, and local laws, support animals are permitted in all areas of this building where the public is allowed to go.

service animal is defined as a dog (or, in some cases, a miniature horse) that is individually trained to perform tasks for a person with a disability. An emotional support animal provides comfort or emotional assistance that alleviates one or more identified symptoms or effects of a person’s disability. While on the premises, support animals must remain under the handler’s control and behave appropriately. We are committed to ensuring equal access and a welcoming environment for all.

Modifications to Policies and Procedures : SCHEV will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all of its programs, services and activities.

Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service or activity of SCHEV should contact the office of the ADA coordinator at ADACoordinator@schev.edu as soon as possible, but no later than two days before the scheduled event.

The ADA does not require SCHEV to take any action that would fundamentally alter the nature of its programs or services or impose an undue financial or administrative burden.

SCHEV will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy, such as retrieving items from locations that are open to the public but are not accessible to persons who use wheelchairs.

SCHEV ADA Grievance Procedure: If you wish to file a complaint, please read our grievance procedure policy and complete the online form, or direct your complaint to the ADA Coordinator. In addition, contact ADA Coordinator at ADACoordinator@schev.edu if you need an alternative way to file the complaint.

Record Retention

All complaints, supplemental or clarifying information, other correspondence or records received, and final determinations will be retained by SCHEV for three years from the date of the final determination by the ADA Coordinator or the CAO if appealed.
