A BILL to amend the Code of Virginia by adding a section numbered 60.2-616.1, relating to unemployment compensation benefits for graduate students employed for a fixed period.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 60.2-616.1 as follows:

§ 60.2-616.1. Benefits based on employment as a student summer employee.

A. As used in this section:

"Graduate degree program" means an accredited academic program of study provided by an institution of higher education for students that have been awarded a baccalaureate degree, which academic program culminates in the awarding of a masters, doctoral, or professional degree.

"Graduate student" means an individual enrolled in a graduate degree program.

"Student summer employee" means a graduate student who (i) is employed to perform services for wages only during a summer break period and (ii) at the time of his hiring there exists a reasonable expectation that he will continue his enrollment in the graduate degree program following the summer break period.

"Summer break period" means a fixed, stated limited period between the spring and fall semesters of the graduate degree program in which a graduate student is enrolled, for which period an employer hires a graduate student to perform services for wages.

B. Benefits based on services performed as a student summer employee shall not be paid to any individual for any week of unemployment that commences during any period outside of the summer break period for which the graduate student was employed, if the individual was notified in writing at the time of his hiring that his employment is only for the summer break period.
